Even proponents of the unn mil lion project expect additional delays and a court battle that could last uui luan a year. The powerful maritime lobby, which sees an economic threat, plans to resume its sophisticated campaign against the pipeline. "It's a bad idea," declares pipeline critic Lawton "Bud" Chiles III, a Tallahassee lobbyist working for shipping interests. Since 1974, a Continental subsidiary has been seeking permission to expand its southern pipeline net- worK so it could carry fuel products from Baton Rouge, to Fort Lauderdale in South Florida. The subsidiary, Transgulf Pipeline wants to convert an existing natural gas line into a common-carrier pipeline to transport gasoline, jet fuel, diesel, kerosene and light heating oil. Now, gasoline and other refined petroleum products arrive in Florida ports via tankers and barges. The controversial project got a boost last month when the Federal Energy Regulatory Commission gave its blessing.
Pipeline opponents have asked for a rehearing in Washington, which is viewed by both sides as a prelude for an appeal to federal court. Meanwhile, the opponents will try to inspire public dissatisfaction with the project by making these claims: The pipeline would put seamen out of work and hurt port areas such as Broward County, home of Port Everglades. In response, the pipeline company says protests about job displacement and economic harm to port cities have been exaggerated. Transgulf President Allen D. Dorris likes to quote from the findings of the federal regulatory report: "The limited injury which maritime interests may suffer is an unavoidable result if the public is to reap the much larger benefits of Increased competition, improved energy security, energy savings and cost efficiency." Continental could gain too much power, or even a monopoly, by controlling transportation of fuel into Florida, say pipeline critics.
The pipeline company says its project would offer healthy competition to the shipping interests that bring in nearly all of Florida's fuels. Further, Transgulf claims its pipeline would save an estimated $1.5 billion in transportation costs during Its first 20 years. Environmental risks are too great because the pipeline would be buried over major water supplies. "A pipeline leak could affect the drinking water of hundreds of thousands of people," warns Chiles, son of Sen. Lawton Chiles, D-Fla.
Opponents think the environmental issue probably is their best weapon. However, some respected environmental groups have supported the pipeline for years, arguing that it would be less troublesome than shipping 1974, the Florida Audubon Society, the Florida Wildlife Federation and a number of other statewide environmental organizations have supported the Transgulf pipeline," Audubon Vice President Charles Lee wrote to Gov. Bob Graham in March. "We have done so because an evaluation of the historical record of pipelines reveals that they are inherently far safer than barge and tanker shipment." Audubon's Lee and David Gluck-man of the Sierra Club urged Graham to veto a 1982 bill designed to stall the pipeline. The governor did so, saying the state shouldn't be drawn into economic disputes between competing Industries.
No one familiar with the pipeline dispute would be surprised if opponents submitted anti-pipeline legislation again in 1983. "The governor Is the key," says Ckiles, adding that Graham might not veto legislation if voters perceive the pipeline as too risky. Even if the Legislature sidesteps the issue next year and the courts approve the project, Continental mast get some 300 permits from various levels of government, says company spokesman Rolf W.
